It truly sucks that I get the filings so much later.  The envelope is postmarked by LexisNexis File & Serve on 3/3/09. That’s probably because it wasn’t e-filed until 5:39 PM on the 2nd.

It was pure coincidence that I got it “already” since I only check my mailbox once a week as it’s a few miles from my house.

Exhibit 1 was NOT served and I emailed attorney Dorweiler:

Doctor Hollander got extension to file responsive pleadings to me counter claims

Attorney Dorweiler emailed this afternoon, requesting an extension till Friday 3/13/09 and since they gave me an extension, I don’t have a problem with that.

However, as I recall from reading the rules, we need to prepare a case management plan before I can conduct discovery.  So I just wrote to her:

Ms. Dorweiler,

No problem, Friday is fine.

Been meaning to contact you to see when we can work on the case management plan, as I would like to submit my written discovery ASAP.  I need to find out who and where Mathew Hilton is so that I can have him served.

They’ll probably file a motion to dismiss for at least some of the claims, but that’s ok.   I’ll have to do a LOT more research and am still wondering whether I shouldn’t file a new suit in FEDERAL court. 

Haven’t had ANY time to work on this as I’ve been busy working on my response to the credit bureaus’ and NCO’s lying lawyers motion to dismiss.

It’s 17 pages long, but if you have an interest in how COMPLETELY and TOTALLY corrupt the American judicial system is and what I’m going to DO about it, reading it will be worth your while.

The similarities to THIS case are unbelievable.  Totally different claims, but the IDENTICAL lying lawyers.   And I already documented perjury by the Experian employee Kimberly Hughes when I deposed her.

So now I got TWICE the motivation to pursue the lying lawyers.

Monday’s communications highlights

Received the response from Dr. Hollander’s attorney Dorweiler in the afternoon:

Ms. Baker,

I am in receipt of your email.  We have neither hired nor directed anyone to harass you.

It took them all day to come up with this response.

Conspicuously absent is the outrage over the harassment and apparently they did NOT send a subpoena to Comcast to identify the harasser.

Presumably, that’s because they know exactly who the harasser is and/or they know that it wouldn’t benefit Dr. Hollander to stop and expose him/her.

I started to get ready for my complaint and still wasn’t sure whether to submit my complaint.

The pictures could only have been obtained from the process server in Arizona or the lawyers in Colorado. 

So I replied:

Ms. Dorweiler,

As I will be filing a harassment complaint, please let me know whether your office had the process server’s pictures of my home and whether you provided the pictures to doctor Tameira Hollander or anyone else.

If Dr. Hollander did NOT get the pics, it seems like they must have  been provided to the harasser by the process server. So I sent another email:

Ms. Dorweiler,

As the harasser had access to the pictures the process server took while trespassing on my property, I need all info about the process server such as contact info, affidavit of service, etc. ASAP for law enforcement.

I didn’t receive a response yet.  I’m still wondering where I should file the report.  If the pictures came from the process server, that’s a logical start for the investigation and I’ll start with the sheriff in Kingman.

One thing I learned over the years is that you really have to do the work FOR law enforcement if you want to get results.  Steve Kirsch (http://junkfax.org/) did a TON of work and he was quite successful getting convictions.  If I only was a millionaire …

And I got two more harassment emails from “Matthew Hilton.”

S/he doesn’t know when to quit.  While he claims to be in Seattle and the IPs are in WA, he also claimed to want to “help” me and it’s not that hard to call Seattle long distance to submit comments.

Mr. “Hilton” ignored my repeated requests to not email and to not post comments at my sites and he continues to attack me.

I will be filing a harassment complaint unless you ensure that the harassment stops IMMEDIATELY and PERMANENTLY.

Due to the information Mr. “Hilton” emailed to me, including pictures taken on my property by the process server (without my permission and while trespassing on my private property), I believe that Mr. “Hilton” either has access to my file at your firm or at the process server.

A couple of email excerpts received from “Matt Hilton” on 1/18/09 around 11:30 PM:

“We are going to get you this time.”

and

“Do you really live in that shithole?”

As I’m not a lawyer or doctor, I don’t live in a mansion.  Do I need to apologize for not being wealthy? 

Does it mean that I can be harassed and attacked with impunity?

Are your firm and/or doctor Tameira Hollander paying Mr. “Hilton” to harass me?  

Are you going to have me KILLED?

Or is doctor Tameira Hollander on drugs and pretending to be Mr. “Hilton”?

Regardless of his true identity, this is your only chance to avoid getting involved in a criminal investigation.Here is the complete email header:

If you really don’t know who that thug is and you provide a copy of your subpoena to Comcast and their reply, I’ll hold off on the harassment complaint.

Until now, I mostly felt sorry for Dr. Hollander.  I have not yet done an asset search for her, I have not searched for her home, her family, her kids, pictures, etc.

I will of course update with their response (if any) and I suppose I need to work on a new press release.

I can’t believe this is happening.  It’s like time travel back to the days when I exposed the penny stock criminals / drug dealers and credit scammers.  Tameira Hollander is a DOCTOR!

And I suppose I better get started on a real estate search for doctor Hollander and her attorneys.   My chances of finding a good lawyer are a lot better when there are assets for the legal fees and a large judgment/settlement.

I don’t even know WHERE to file a harassment complaint.  When I filed the perjury complaint against attorney Keith Knochel, I had to call the Bullhead police.

When I got harassment phone calls, a deputy in Kingman wrote up the complaint.  I didn’t have to pursue it because the harassment calls stopped after I posted the complaint info.  That was a penny stock scammer involved with Reynaldos.

It’s too bad CreditSuit.org is down, there are many posts about the Miller/Magedson litigation and I got involved with how Miller (in FL) could file a complaint against Magedson in AZ.  Miller claimed they wouldn’t take his report about Magedson sending his SSN and other personal data to me. 

Of course I’d never publish anyone’s personal data and subject them to ID theft, so I forwarded Magedson’s email to Miller even though I was NOT on Miller’s side.  I think I ended up talking to a police officer in Phoenix who agreed to take Miller’s report.

Well, I’m seeing FLOATERS again.  That only happens when I’m under a lot of stress and it means that I shouldn’t drive.  And the only way to fix it is to get away from the computer for a few days and take time off relaxing.

Somehow, I don’t see that happening any time soon.

NO documents to support the false allegations

My renewed request for documents to support the ludicrous allegations was once again ignored.

As expected, since it’s difficult to document something that doesn’t exist.

So I sent her the stipulation draft.

And tomorrow I’ll post the press release.  I hope it’s DONE.  I’m really sick of rewriting it, but I want to review it one more time.

1/6/09: My summary of issues to attorney Dorweiler

Since attorney Lauren Dorweiler is apparently new to this case, I decided to summarize the issues:

Ms. Dorweiler,

While you may certainly dismiss the lawsuit, I will NOT be censored and I will continue to publicize the issues and I will seek restitution. 

Since this is clearly a harassment lawsuit, the allegations are entirely false AND Dr. Hollander committed perjury, I will publicize this lawsuit to make it THE free speech case.

There are four issues:

1) My right to publish the truth
2) My damages due to this harassment suit
3) Punitive damages to send the message that professionals can not retain attorneys to silence legitimate criticism (to be donated to non profit organizations of my choice)
4) Dr. Hollander’s incompetence.  I don’t want to be responsible for a patient’s death because I didn’t do everything possible to stop her from treating patients.

Bad doctors KILL patients and a doctor who files frivolous and harassment lawsuits, commits perjury and is not capable of properly completing a simple contact form and submitting her correct email address should NOT be treating patients.

I don’t know what causes Dr. Hollander’s problems, I have nothing against her personally and I hope she can get treatment.

My CreditSuit.org website will remain shut down until I get the court order vacated or until Dr. Hollander decides to mitigate my damages.  I am confident that ultimately Dr. Hollander will pay for my damages and the only questions are when she’ll pay and how much she’ll pay.

Ms. Dorweiler, if CreditSuit.org wasn’t shut down, you could have a quick look and you’d know immediately that the more you hurt me, the harder I fight.

There is no logic, it’s just how I am.  I don’t choose the easiest path to make the most money.  I don’t spread my legs just because it hurts less.  I’m not a slave and I’m not a coward.

I am a free human being and I fight for my rights. 

Attorney Johnson wrote to me:

Ms. Baker, I am Dr. Hollander’s attorney. I gather you like to “mix it up” and involve yourself in “causes”. …”

Attorney Johnson was fully aware that I would put up the fight of my life and he cleverly turned the Baileys’ issues into MY cause, presumably because doctors have deep pockets.

Usually I delete a link when I find out that the link went bad.  

If nobody had DEMANDED that I delete the link, Dr. Hollander’s name  most likely would have disappeared from my site.  Dr. Hollander can thank her attorney for destroying her career.

“Our goal in all of this is to remove negative and libelous references to Dr. Hollander from the internet.”

You certainly may pursue your goals, but TRUE negative references are NOT libelous and this lawsuit is therefore considered malicious prosecution.

If you take the time to actually review the filings, you will notice the ABSENCE of any exhibits substantiating the obviously FALSE allegations against me.

In my email to attorney Johnson I requested documentation for the obviously false allegations.  I received NOTHING.  The emperor has no clothes. 

It’s ALL lies and perjury.

If you have ANY evidence whatsoever to document any of the absurd allegations against me, PLEASE provide those documents and I will be glad to discuss what needs to be corrected.

“We are willing to grant you an extension of time to respond to our Complaint.”

Preparing the press release and my request for extension to respond to the complaint

My 1/4/09 email to Dr. Tameira Hollander’s attorney Irving G. Johnson:

Dear Mr. Johnson:

Since you’ve been monitoring my websites, I’m sure you noticed that I shut down CreditSuit.org, my major website and source of income, to comply with your court order (found outside my garage) and I assume you reviewed my publications about this lawsuit at http://doctor-tameira-hollander-litigation.info/.

1)  As I am now preparing a press release regarding this lawsuit to retain an attorney, please advise whether there is ANYTHING at all that’s incorrect, incomplete, misleading or in any way objectionable at  http://doctor-tameira-hollander-litigation.info/ and especially at http://doctor-tameira-hollander-litigation.info/news/factual-summary/.

My readers find it hard to believe that you would file a lawsuit without ever submitting to me a single objectionable excerpt from my publications.

To date, and despite my SPECIFIC request on 8/10/08, you and your client Dr. Tameira Hollander failed to identify a single allegedly libelous statement published at any of my websites.

Please advise if you, Dr. Tameira Hollander or her representative(s) submitted ANY communications to me regarding this matter that are NOT listed at http://doctor-tameira-hollander-litigation.info/news/factual-summary/.

After I wasted DAYS on this crap 3 weeks ago, I could not work myself up to dealing with this lawsuit.  One night I spent a few hours researching, it’s just so depressing.

Last week I started to have nightmares about this suit.  I was in court and there were so many people.  Many SICK and OLD people, with walkers and in wheelchairs.  Like traffic court for the 70+ crowd.

It is so incredibly aggravating to have your rights violated, to know that you have no rights when you’re not wealthy, to know that most judges couldn’t care less about justice, to know that spreading your legs will be less painful than putting up a fight.

The harder you fight, the greater the damages.

A lesson learned a thousand times.

Why am I STILL fighting?
