FINALLY back after 4 long months of being censored

On 11/19/09, judge Rafferty ruled that I have the right to publish this lawsuit and to discuss this lawsuit.

He also ruled that the link I had posted to doctor Hollander’s former patient’s site was NOT defamation because the law provides me with immunity. The California supreme court had made it clear that only the person who originally made a defamatory statement is liable.  I will update with the specific legal issues later.

Judge Rafferty also ruled that doctor Hollander did NOT commit perjury when she falsely accused me of having maintained a “companion site” to the Baileys’ (former patient and husband) website, that I refused to remove defamatory statements, etc.   The RECORD speaks for itself.

So I have to remove my statements regarding doctor Hollander’s perjury from the web and I’m also not allowed to express my derogatory opinion of doctor Hollander. 

How could I be so dimwitted and think that sworn false statements are perjury? 

Of course I will APPEAL this ruling, but I will also comply with the court’s order. 

Of course I cannot remove my statements at OTHER sites where I can’t edit or delete my posts.  So judge Rafferty stated that I had to attempt to remove those statements and I’m still waiting for the written order to provide to these websites, ripoffreport.com and complaintsboard.com.

I’ve already edited my own sites and I can’t believe it took me almost a week to bring this blog back online.  I’m so busy, still trying to finish insulation and sheet rock work in my unfinished house and I have a gazillion projects going.

However, fighting for my right to FREE SPEECH is way at the top of my list. 

This is no longer about doctor Hollander (who should sue her attorney Irving Johnson for malpractice), but it’s about being able to expose crooks and frauds of all sorts. 

Any one of the subjects of my previous documentaries and investigations could simply sue me to get DELETION of their atrocities if they are allowed to falsely accuse me of defamation and the judges order entire websites removed.

In the last few weeks I had TWO more legal threats and I’m working on a new site with MULTIPLE blogs for the many morons, liars, cheats, thieves, spammers, scammers, criminals and frauds I deal with on a regular basis.

I will NOT assimilate and I will NOT become one of THEM.

I AM on my way out  and I’m perfectly capable of enjoying my life, off the grid, growing our food and building.  But the harder the scum tries to silence me, the more time and energy I will spend on defending my 1st Amendment right to FREE SPEECH.

1/6/09: My summary of issues to attorney Dorweiler

Since attorney Lauren Dorweiler is apparently new to this case, I decided to summarize the issues:

Ms. Dorweiler,

While you may certainly dismiss the lawsuit, I will NOT be censored and I will continue to publicize the issues and I will seek restitution. 

Since this is clearly a harassment lawsuit, the allegations are entirely false AND Dr. Hollander committed perjury, I will publicize this lawsuit to make it THE free speech case.

There are four issues:

1) My right to publish the truth
2) My damages due to this harassment suit
3) Punitive damages to send the message that professionals can not retain attorneys to silence legitimate criticism (to be donated to non profit organizations of my choice)
4) Dr. Hollander’s incompetence.  I don’t want to be responsible for a patient’s death because I didn’t do everything possible to stop her from treating patients.

Bad doctors KILL patients and a doctor who files frivolous and harassment lawsuits, commits perjury and is not capable of properly completing a simple contact form and submitting her correct email address should NOT be treating patients.

I don’t know what causes Dr. Hollander’s problems, I have nothing against her personally and I hope she can get treatment.

My CreditSuit.org website will remain shut down until I get the court order vacated or until Dr. Hollander decides to mitigate my damages.  I am confident that ultimately Dr. Hollander will pay for my damages and the only questions are when she’ll pay and how much she’ll pay.

“The Baileys have agreed that it is best to put this entire situation behind us.  We hope you agree”

Ms. Dorweiler, if CreditSuit.org wasn’t shut down, you could have a quick look and you’d know immediately that the more you hurt me, the harder I fight.

There is no logic, it’s just how I am.  I don’t choose the easiest path to make the most money.  I don’t spread my legs just because it hurts less.  I’m not a slave and I’m not a coward.

I am a free human being and I fight for my rights. 

Attorney Johnson wrote to me:

Ms. Baker, I am Dr. Hollander’s attorney. I gather you like to “mix it up” and involve yourself in “causes”. …”

Attorney Johnson was fully aware that I would put up the fight of my life and he cleverly turned the Baileys’ issues into MY cause, presumably because doctors have deep pockets.

Usually I delete a link when I find out that the link went bad.  

If nobody had DEMANDED that I delete the link, Dr. Hollander’s name  most likely would have disappeared from my site.  Dr. Hollander can thank her attorney for destroying her career.

“Our goal in all of this is to remove negative and libelous references to Dr. Hollander from the internet.”

You certainly may pursue your goals, but TRUE negative references are NOT libelous and this lawsuit is therefore considered malicious prosecution.

If you take the time to actually review the filings, you will notice the ABSENCE of any exhibits substantiating the obviously FALSE allegations against me.

In my email to attorney Johnson I requested documentation for the obviously false allegations.  I received NOTHING.  The emperor has no clothes. 

It’s ALL lies and perjury.

If you have ANY evidence whatsoever to document any of the absurd allegations against me, PLEASE provide those documents and I will be glad to discuss what needs to be corrected.

“We are willing to grant you an extension of time to respond to our Complaint.”

Thank you.  Should I send you the stipulation as a pdf and then you fax the signed copy back to me or how do you want to handle this?

I have a rough draft of the press release, hopefully will get it done by tomorrow night.  Another day WASTED.

And I’m starting to feel sorry for Dr. Hollander, she got some horrible legal advice.  If CreditSuit wasn’t censored, I’d post some relevant links.
